I've witnessed this happen right in front of me at a brick and mortar store.
There was a captain rex helmet in a pile of sets the couple said they got in
a storage locker auction... Problem is the rex helmet just came out the day
before and storage locker auctions usually take 30-90 days from last payment
to auction in my area. I didn't realize this was a thing at the time but
I asked the salesperson "how did they win that in an auction if it just came
out yesterday?" and they told me "we don't ask a lot of questions.
They offered them 33% of the retail value.

It looks like they were selling here too but got suspended last year. The logos
for this BL store on Internet archive match the ones used by the physical store.

This appears to be casual theft. Retailers seem to be less likely to take action,
unless/until it becomes a cumulative problem (i.e. successive misdemeanor offenses
finally hit the bar where it becomes a felony). One of the really unfortunate
side effects, is that if a lot of full price product is being taken by criminal
means, then there will be little remaining for clearance deals. Once upon a time
clearance deals were what fed BL sellers with product.

I think most shelves are cleared by buyers these days, as LEGO is much more popular
for both consumers and resellers than in the past. Here, it used to be possible
to get at least 30% off pretty much every (non-exclusive) set if you didn't
mind waiting and discounts of 50% were fairly common. Whereas now shelves are
cleared at 20% off.
